END USER LICENSE AGREEMENT (EULA) FOR CHATGPT EDUCATION 
 
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Digital Ventures Pte Ltd FZ LLC ("DVFZ"), operating the website ChatGPT Education ("Website"), which is an AI tool for test preparations and study guides. This EULA governs your use of the Website and the services provided through it. 

DEFINITIONS 

• "Website" refers to ChatGPT Education, operated by Digital Ventures Pte Ltd FZ LLC ("DVFZ"). 
• "Services" means all features, functions, and content provided through the Website. 
• "AI-generated content" or “Ouput” refers to any material produced by the artificial intelligence tools on the Website. 

1. License Grant 

DVFZ grants you a non-exclusive, non-transferable, limited license to access and use the Website and its services for your personal, non-commercial use, subject to the terms and conditions set forth in this EULA. 

2. Permitted Use 

You are permitted to use the Website to: 

• Access and interact with AI-driven test preparation tools and study guides. 

• Participate in AI-driven mock tests patterned after your chosen exam. 

• Access AI-driven practice guides and other educational resources provided on the Website. 

3. Prohibited Use 

You agree not to: 

• Copy, modify, or distribute any content provided on the Website without prior written consent from DVFZ 

• Use the Website for any unlawful or fraudulent purposes. 

• Attempt to gain unauthorized access to any part of the Website, other user accounts, or any computer systems or networks connected to the Website. 

• Use the Website in any manner that could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website. 

4. Intellectual Property 

ChatGPT.Education is the property of DVFZ or its licensors. You are granted no rights or licenses in or to any of the aforesaid, except as expressly set forth in this EULA. 

5. AI-Generated Content 

The materials generated and driven by the AI tools on this Website (“Output”) are for educational and informational purposes only. Due to the nature of AI, it can generate errors and inaccuracies. Users should apply their best judgment and discretion when using AI-generated content. DVFZ and its affiliates, including OpenAI, do not hold any liability for any outcomes, legal or otherwise, resulting from the use of AI-generated and driven content. If you choose to copy, use, or distribute any AI-generated content, you do so at your own risk. 

Accuracy Disclaimer 

Artificial intelligence and machine learning are fields that evolve fast. While we continually strive to enhance our Services to improve their accuracy, reliability, safety, and usefulness, due to the nature of machine learning, there may be instances where the Output generated by our Services does not accurately represent real people, places, or facts. 

By using our Services, you acknowledge and agree that: 

1. The Output may not always be accurate. It is important not to rely solely on the Output from our Services as the definitive source of truth or factual information, nor as a substitute for professional advice. 

2. You are responsible for evaluating the Output for its accuracy and suitability for your particular use case, including conducting human review and fact-checking where necessary, before utilizing or sharing any Output from the Services. 

3. You must not use any Output related to a person in a manner that could have legal or significant consequences for that person. This includes making decisions regarding credit, education, employment, housing, insurance, legal matters, medical issues, or other important areas based on the Output. 

Additionally, our Services may generate Output that is incomplete, incorrect, or offensive and does not reflect our views in our company. If the Output references third-party products or services, this does not imply any endorsement or affiliation with those third parties.

In no event shall DVFZ, ChatGPT Education, OpenAI, or any of their affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website, whether based on contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages. 

8. Trademarks and Links 

All trademarks, logos, and service marks displayed on the Website are the property of their respective owners. Any links provided to third-party websites are for your convenience and do not constitute an endorsement by DVFZ or its affiliates. DVFZ and its affiliates are not responsible for the content or practices of any linked third-party websites. Users should review the terms and privacy policies of any third-party websites they visit. 

9. Termination 

DVFZ reserves the right to terminate your access to the Website at any time, without notice, for conduct that it believes violates this EULA or is harmful to other users of the Website, DVFZ, Genius Exam Coaches Program, or third parties, or for any other reason. 

10. Payments 

For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You’re responsible for all applicable taxes, and we’ll charge tax when required. If your payment cannot be completed, we may downgrade your account or suspend your access to our Services until payment is received. Payments are non-refundable, except where required by law. These Terms do not override any mandatory local laws regarding your cancellation rights. We may change our prices from time to time. 

11. Indemnity 

As a business or organization, you agree to indemnify and hold harmless us, our affiliates, and our staff against any costs, losses, liabilities, and expenses (including legal fees) to the extent permitted by law. This indemnification covers any third-party claims resulting from your use of our Services and Content or any breach of these Terms. 

12. Governing Law 

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which DVFZ operates and distributes, without regard to its conflict of law principles. That any dispute arising out of or in connection with this EULA, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The Agreement is governed by the laws of Singapore. 

13. Security Measures 

We take reasonable steps to protect your information from unauthorized access, use, or disclosure. However, no internet or email transmission is ever fully secure or error-free. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. 

14. Compliance With Laws 

You agree to comply with all applicable laws and regulations in connection with your use of the Service, including data protection and privacy laws. 

15. Data Transfer and Storage 

Your data may be stored and processed in any country where we have facilities or in which we engage service providers. By using the Service, you consent to the transfer of information to countries outside your country of residence, which may have different data protection rules. 

16. Changes to Services

We reserve the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. We will not be liable to you or any third party should we exercise our right to modify or discontinue the Service. 

17. Beta Features
